1. About these terms
These terms govern your use of the CarBayz marketplace (the "Platform") operated by CarBayz Technologies Pvt Ltd ("we", "us"). By creating an account or transacting on the Platform you accept these terms.
2. Eligibility
You must be 18+ years old and an Indian resident. You must provide accurate KYC information; misrepresentation may result in account suspension and forfeiture of any ongoing transactions.
3. Buying a vehicle
All listings carry a 200-point inspection report; review it before reserving. A non-refundable agreement is generated at reservation. Payment captures token and balance via Razorpay (or NEFT for large-ticket). 7-day return is governed by the Sale Agreement attached to each order.
4. Selling a vehicle
The instant quote is an estimate; the binding final offer is made after physical inspection. Pickup and payment timelines are set out in the Purchase Agreement signed by you electronically.
5. Partner / dealer auctions
Dealer participation requires a ₹2,00,000 refundable security deposit and KYC. Bids are sealed; ₹50,000 security is held per bid. Winning bids are binding. A 2% platform fee applies on each won lot. Detailed terms are in the Partner Onboarding Agreement.
6. eSign and non-repudiation
All agreements are signed via 6-digit OTP delivered to your registered phone. Each signature is recorded with timestamp and originating IP. Signed agreements are enforceable under the Information Technology Act, 2000 (India).
7. Payments and refunds
Razorpay is our primary payment processor. Refunds for cancelled orders are initiated within 5 working days and credited to the original payment instrument. Disputes should be raised within 30 days.
8. Prohibited use
You may not use the Platform for money laundering, vehicles with stolen or disputed title, or to circumvent any Indian law including the Motor Vehicles Act.
9. Limitation of liability
Our liability is limited to the platform-fee or token amount, whichever is higher. Vehicle warranties beyond the standard 1-year engine + gearbox cover are with the manufacturer or third-party warranty provider.
10. Governing law
These terms are governed by the laws of India. Courts at the location of our registered office (Mumbai) shall have exclusive jurisdiction.
